This policy paper is dedicated to assessing the extent of political influence within the operations of the Prosecutorial Council, following the adoption of amendments to the Law on the State Prosecutor's Office in 2021. These amendments were introduced by the newly established ruling majority following the government change in 2020, seemingly with the intention of increasing their political influence over Montenegro's Prosecutorial Council. The most recent EU Annual Report on Montenegro underscores the fact that the recommendations put forth by the Venice Commission regarding the risk of politicization of the Prosecutorial Council, as articulated in their 2021 Opinion, remain unaddressed. This represents a substantial impediment for Montenegro in fulfilling the interim requirements for EU accession negotiations in Chapter 23.
